This Indemnity between Quincy Media, Inc. and its affiliates, including WEEK 25 and its affiliates are entered into as of the date below, in connection with the contest/sweepstakes Olympic Trivia Contest, which is scheduled to begin on or about February 12, 2018 and to end on or about February 23, 2018. For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, Advertiser hereby represents and warrants that Advertiser and its employees and agents shall comply with all applicable laws, rules and regulations in connection with Promotion. Advertiser further acknowledges and agrees that QMI/Station's only obligations with respect to the Promotion are to promote the Promotion on air, in print, and/or through digital media, as agreed by the parties. All other aspects of the conducting and administration of the Promotion will be conducted and administered by Advertiser and/or entities other than QMI, including but not limited to the collection and processing of entries, the selection of contestants, the selection of prize finalists, the provision and operation of Promotion prize fulfillment, winner notification, and verification of winners. Advertiser represents and warrants that the Promotion is and will be lawfully administered and conducted in substantial conformity with the official rules of the Promotion and that the official rules accurately, completely, and truthfully describe the manner in which the Promotion will be conducted and administered. In the event that QMI or WEEK provides sample rules to Advertiser, Advertiser acknowledges and agrees that such rules are for informational purposes only, and that QMI/WEEK 25 makes no warranty or certification as to the accuracy or completeness of, and shall have no liability in the event of an actual or alleged deficiency in, the official rules of the Promotion. Advertiser hereby releases and discharges QMI, its employees and agents (the “Released Parties") from any claims or actions arising from or relating to the Promotion, and shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, actions, complaints, losses, damages, expenses or liabilities (including reasonable attorneys' fees where permitted) arising from or relating to the Promotion and the breach of any of Advertisers' representations or obligations under this Indemnity. This Indemnity shall supersede any other provision or agreement, whether written or otherwise, in effect on this subject prior to the execution of this Indemnity. The undersigned executing this Indemnity on behalf of Advertiser (“Undersigned") represents and warrants that he or she has authority to enter into this Indemnity on behalf of the Advertiser and to bind the Advertiser to the obligations and terms of this Indemnity, and in the event the Undersigned does not have such authority, then, in executing this Indemnity, the Undersigned warrants and agrees to be bound to the terms of this Indemnity and to be responsible and liable hereunder. HOI Privacy Policy Our Commitment to Privacy WEEK 25 respects the privacy of users on the Internet and has developed this privacy policy to protect user privacy on its Web sites. The purpose of this policy is to explain the types of information WEEK 25 obtains about the users of the 25 News Facebook page, how the information is obtained, how it is used, how it may be disclosed to others, and how users can restrict its use or disclosure. Personally Identifiable Information Online privacy concerns focus on the protection of "personally identifiable" information which an individual or customer reasonable expects to be kept private. Non-Personally Identifiable Information WEEK does collect some non-personally identifiable generic information about our users as a means of measuring the effectiveness of our web sites. WEEK 25 identifies certain user information in the normal course of operation, but such information does not reveal a user's personal identity. We collect this information only in the aggregate and use it to evaluate and improve our web sites. The following are examples of non-personally identifiable generic information: IP Addresses: An IP address is a number that is assigned to a user's computer whenever that user is using the World Wide Web. WEEK 25 collects IP addresses for the purposes of system administration security and to report aggregate usage information. WEEK 25 does not link IP addresses to any personally identifiable information. Computer settings: Settings, technical and other information from your computer, such as your operating system, browser version, connectivity, various communication parameters and other information related to the operation and interaction of WEEK 25 web sites may be collected by WEEK 25. Except as otherwise provided in this policy, WEEK will use such information solely in order to provide technically appropriate formatting of information provided by WEEK 25. The collection of this information will not include any personally identifiable information about you or any individual user. Cookies are pieces of information that are used for record keeping purposes. Cookies allow WEEK 25 to save certain information about a user, such as individual preferences, in order to facilitate and enhance the user's future activity on the WEEK 25 web site.
