Lawsuit filed against Pontiac officer who allegedly hit, killed pedestrian: report

A wrongful death lawsuit has been filed against a Pontiac police officer who struck and killed a pedestrian on Route 66 last summer.

The Pontiac Daily Leader reports a law firm representing the estate of Rita Murphy, 55, has filed suit against Officer Jace Koerner and the Pontiac Police Department in connection with the August 21 death. Murphy was hit by a police squad car at the intersection of Route 66 and Howard around 2 a.m. on that day. 

The Leader reports the lawsuit alleges Koerner was driving that police vehicle and was speeding at the time of the accident. 

The Leader reports it has filed a Freedom of Information Act request to the Illinois State Police for an accident report. The Illinois State Police investigates officer-involved deaths. 

The suit filed in Livingston County Court by Murphy's heirs lists four counts of negligence and willful or wanton conduct on Koerner's part. Each count asks for $50,000 in damages to pay for funeral costs and to compensate for the family's suffering.
