PEORIA, Ill. – A former Peoria man tells a Peoria County court that it was his now dead brother, who killed a Peoria County Sheriff's deputy in 1970.

Cleve Heidelberg was convicted in 1970 for shooting and killing Sergeant Raymond Espinoza.

However, the journal star reports that videotaped testimony from Matthew Clark last fall, puts the blame on James Clark.

Matthew Clark claims his brother was angry that another of their brothers, was killed by police, along with the state leader of the black panther party during a 1969 raid in Chicago.

Heidelberg and his team want his case reopened, and are asking for a special prosecutor claiming state's attorney Jerry Brady is biased.

Heidelberg has spent the past four decades in prison for the murder.
