A court hearing is scheduled Thursday for a convicted murderer, wanting to overturn his conviction.
78-year-old Cleve Heidelberg was found guilty of murdering Peoria County Sheriff's Sergeant, Raymond Espinoza, in 1970.
Heidelberg, who is acting as his own attorney, is pushing for a new trial, after discovering new evidence and a confession from another man.
The judge removed state's attorney, Jerry Brady, from the case for alleged bias, but the state has since appealed.
