It will be August at the earliest before a Peoria County jury hears the state's case again two parents accused of starving their five-month-old son to death.

A judge today allowed a defense motion to delay the trial of Tracy Herman and James Sargent until August 4. A trial date had been scheduled for May 12.

The couple is accused of neglecting Benjamin Sargent while he was strapped in a car seat.

Investigators say the infant went for eight days without food or water.

State's Attorney Kevin Lyons says he'll decide in the next thirty days if he will seek the death penalty.

Everytime i see this story it makes me sick inside.. sure they wanna delay as much as they can..doesnt matter to them they have clean beds and 3 meals a day!! I think they should not be fed until the trial is over!!!! lets see how long they can last!! DEATH PENALTY PLEASE!!!

Once again I say Please seek the death penalty Mr. Lyons. Make them examples and send the message that we do not tolerate child neglect. Make them answer to the Lord. Don't give them jail time where they might suffer for a while. To me it would be the same slow death Benjamin Sargent experienced. The Lord will judge them and send them where they belong.
