"If they go out there and take care of all the drainage issues more power to them and we would appreciate that because it is affecting our residents", said Allen.

The trail and rail issue has been ongoing for nearly 10 years. Proponents of the trail would like the railway to be completely replaced with a trail.

Allen adds, "What we're trying to do is build a case to present to the Service Transportation Board why we're better served and the line is better served as a trail and recreational hiking biking trail as opposed to a railroad that has virtually no use and is falling apart."

Pioneer Rail Road CEO Mike Carr said, "I understand Mayor Allen's position because looking up and down the Heights there probably any business opportunities for them to actually move the rail that would benefit the heights".

But even though the railway is getting a 60 day notice, the railroad still has questions.

Carr remarked, "I don't quite understand or we need to research a little more what entails drainage for example if it starts on the railroad and drips down, is that the issue?"

The village says the railway has to comply with the village or else they'll go to the Service Transportation Board to try to remove their service. But rail officials say that's not possible.

Mayor Allen said, "They are to maintain and take care of these drainage issues on an annual basis. We don't show any record of where it's actually been done so we wanted to bring it to their attention and also as a part of the agreement we have a, give them a 60 day notice and if they don't remedy the situation we could then remove them from the rails."

"We can't leave until the Service Transportation Board tells us to leave.", said Carr

Officials from Peoria, Peoria Heights, and a Joint Rail Trail Committee will meet Thursday to discuss financial possibilities of potentially adding a trail alongside the rail.
